Default
In the event of a default in payment, the customer will be charged interest on any overdue amount at the rate of 1.5% per monthfrom the due date until full payment is made and shall repay FUJIFILM CSG Technology Limited (FCSGTL) on demand any monies which FCSGTL may expend to make good any failure by the customer to comply with the payment terms.

Ownership
Ownership of goods shall not be passed to the customer until the customer has paid all that is owing to FCSGTL. Until ownership has passed, the customer holds the goods on behalf of FCSGTL under the following conditions:

(a) FCSGTL is permitted to enter onto the customer’s premises to inspect and or repossess the goods;

(b) If the customer sells the goods to a third party, then the customer is accountable to FCSGTL for all proceeds derived from such sale and shall hold such proceeds on trust for FCSGTL ;

(c) If the customer manufactures, intermingles or deals with the goods in such a manner that they become an integral part of any other object, then the customer shall be deemed to do so as agent of FCSGTL and ownership of the goods will remain with FCSGTL as Principal.

Consumer Guarantees Act
Where the goods are supplied for business purposes, the customer agrees that the goods are supplied to the customer for business purposes and that the provisions of the Consumer Guarantees Act do not apply in respect of the supply of such goods. The customer has the right to undisturbed possession of the goods except in so far as that right is varied pursuant to the Company’s rights arising from the reservation of Title to the company until the customer has paid all monies outstanding in terms of this Agreement AND THE CUSTOMER HEREBY ACKNOWLEDGES that the company or its employees or agents has informed the customer that the company shall be entitled at any time to repossess the goods in the event that the customer shall be in breach of the terms of this Agreement whether as to non-payment of monies due or non-performance of the customer’s obligations.
